1. INFORMATION TO THE USER

Who is responsible for the processing of your personal data?

SETDART ONLINE, S.L., will be responsible for the processing of the personal data of those PEOPLE who have created a profile on any of its social networks, and they will be treated in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), Organic Law 3/2018, of 5 December (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information on processing :

1.1 DATA PROCESSING

The data will be processed to maintain a relationship between the USER and SETDART ONLINE, SL (hereinafter the CONTROLLER) that may include the following operations :

  • Process requests and queries submitted to the responsible party
  • Inform about activities and events organized by the person in charge
  • Inform about products or services offered by the controller
  • Interact through official profiles

When the CONTROLLER collects and processes personal data through its social networks, USERS will be informed about the purpose of the data collection, as well as about their rights in relation to their personal data. Personal data will be used only for the stated purposes and will be kept securely.

The Legal Basis of the Processing is the explicit consent granted by the USER for the processing of his/her personal data for one or more specific purposes (article 6.1.a GDPR).

On the other hand, the USER can access the privacy policies of the social network itself at any time, as well as configure their profile to guarantee their privacy.

1.2 DATA RETENTION

The data will be stored according to our data retention criteria. They will be kept as long as the USER does not revoke the consent given as indicated in this privacy policy.

1.3 DATA COMMUNICATION

The information provided by the USER through the CONTROLLER's social networks, including their personal data, may be published, always depending on the services that the USER uses, so it may be publicly available to other third party users of the social networks. From the profile of each social network, the USER can configure what information they want to make public in each case; view the permissions that have been granted; delete or deactivate them; like any third-party application that you no longer want to use.

However, no communication of personal data to third parties outside the social network is foreseen unless it is essential for the development and execution of the purposes of the processing; or if it is to be communicated to providers of services related to communications with which the RESPONSIBLE PARTY has signed the confidentiality and data processor agreements required by current privacy regulations.

1.4 USER RIGHTS

The rights of the USER may only be satisfied in relation to the information that is under the control of the CONTROLLER.

  • Right to withdraw consent at any time.

  • Right of access, rectification, portability and deletion of your data, and of limitation or opposition to its processing.

  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with the regulations in force.

2. USE OF THE PROFILE

The RESPONSIBLE person will carry out the following actions:

  • Access to public profile information.

  • Publication on the USER's profile of all the information already published on the CONTROLLER's social network.

  • Send personal and individual messages through social media channels.

  • Updates on the status of the page that will be published on the USER's profile.

The USER will always be able to control their connections, delete content that is no longer of interest to them and restrict with whom they share their connections; To do this, you must access your settings where you will find different configuration possibilities in relation to the degree of privacy of the user profile on the social network.

3. PUBLICATIONS

The purpose of social networks is to give visibility and dissemination to the activities carried out by the CONTROLLER. These tools store personal data on the servers of the respective services and are governed by their own privacy policy.

The USER, once they are a follower or have joined the CONTROLLER's social network, may publish comments, links, images, photographs or any other type of multimedia content supported by it. In all cases, the USER must be the owner of the published content, enjoy the copyright and intellectual property rights or have the consent of the affected third parties.

Any publication on the social network, whether in the form of texts, graphics, photographs, videos, etc., that threaten or is likely to violate morals, ethics, good taste or decorum, and/or that infringes, violates or violates intellectual or industrial property rights, the right to one's own image or the Law is expressly prohibited. Offensive, defamatory, illegal or inappropriate comments and content will not be tolerated on company profiles.

In these cases, the RESPONSIBLE PARTY reserves the right to remove the content immediately, without prior notice, and may request the permanent blocking of the USER.

The RESPONSIBLE PARTY shall not be held responsible for the content freely published by the USER.

The USER must bear in mind that his/her publications will be known by other users, so he/she is primarily responsible for his/her privacy.

The images that may be published on the social network will not be stored in any file by the RESPONSIBLE PARTY, but they will remain on the social network according to its criteria.

4. DATA OF MINORS OR PERSONS WITH DISABILITIES

It is recommended to review and read the terms of use and privacy policy of each social network at the time of registration, taking into account the different age requirements for registration.

Likewise, the RESPONSIBLE PARTY will be expressly exonerated from any liability that may arise from the use of social networks by minors or people with disabilities, whose access should be under the supervision and control of their legal representatives.

The CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated through our social media profiles and/or our website.
